Annex 15 – Disclosure pursuant to Art. 13 of Italian Legislative Decree no. 196/03 and European Regulation no. 679/2016

Pursuant to Art. 13 of Italian Legislative Decree no. 196/2003 and following the entry into force of EU Regulation no. 679/2016 in accordance with the provisions of art. 13, we wish to inform you of the following:

Purpose of data processing
Your personal data, freely communicated and acquired by us as a result of the activity carried out, will be processed in a lawful manner according to correctness for the following purposes: safety advice in the workplace and marketing of fire-fighting equipment. Your data will also be processed for the purposes set out by the current anti-money laundering legislation (Italian Legislative Decree No. 231/2007 and subsequent amendments). The data processed (common, sensitive, judicial) are updated, relevant, complete and not excessive in relation to the purposes listed above for which they are collected and subsequently processed. In this respect, it is recalled that sensitive data means: “Any personal data suitable to reveal racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation”. Judicial data means: “Personal data disclosing the measures referred to in Art. 3, paragraph 1, letters from a) to o) and from r) to u), of Italian Presidential Decree 313/2002, concerning criminal records, the register of offence-related administrative sanctions and the relevant current charges, or the status of being either defendant or the subject of investigations pursuant to Articles 60 and 61 of the Italian Criminal Code.

Processing methods
The data will be processed, in compliance with the necessary security and confidentiality, through the following procedures: collection of data from the data subject, collected and recorded for specific, explicit and legitimate purposes and used in further processing operations compatible with these purposes, processing in place with the aid of electronic and automated tools (data collection via data transmission or directly from the authorised party).

Legal basis for processing
The legal basis of the processing of your personal data is based on the conclusion of the contract.

Legitimate interests pursued by the Data Controller
The legitimate interests pursued by the Data Controller are given by having to respect and honour the contractual obligations signed between the parties. Pursuant to Art. 6 the lawfulness of the processing is based on the express consent expressed by the data subject, documented in writing.

Compulsory or optional nature of data provision and consequences of any refusal to respond
The nature of the provision of data by you is mandatory so that the data controller can provide the services requested.

Communication of data to third parties
Your data may be disclosed as a result of inspections or verifications (if required), to all the inspection bodies responsible for verifications and checks concerning the compliance with legal obligations. Your data may also be disclosed to companies/professional firms which provide assistance, advice or collaboration to the data controller, in accounting, administrative, fiscal, legal, tax and financial matters, to public administrations for the performance of institutional functions within the limits established by law or by regulations. Your data are not subject to diffusion.

Retention period
Your personal data will be kept for ten years, from the termination of the service provision.

Intention of the Data Controller of personal data
The Data Controller is H3B Srl, Via Mestrina, 11/B – 35035 Arlesega di Mestrino (Pd). Mr. Parisotto Marco is responsible for the processing of data designated for the reply of the interested party in case of exercise of rights. The data subject may at any time exercise the rights reserved to them, sanctioned by art. 7.

Art.7 Italian Legislative Decree no. 196/2003 and EU Regulation no. 679/2006 – Right to access personal data and other rights
The data subject has the right to obtain confirmation as to the existence or otherwise of personal data concerning them, regardless of their already having been recorded, and communication of such data in an intelligible form. The data subject has the right to obtain the indication of: the origin of the personal data; the purposes and methods of their processing; the software applied in case of processing carried out with the aid of electronic instruments; the identity of the data controller, of the data manager and of the representative appointed under article 5, paragraph 2; the subjects or categories of subjects to whom personal data may be communicated or who can have access to them as appointed representative in the given jurisdiction of the country, of managers or agents. The data subject has the right to obtain: the updating, rectification, or, when there is interest, the integration of data; the conservation in relation to the purposes for which the data are collected or subsequently processed; the attestation that the operations referred to in letter a. and b. have been brought to the their attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case where such fulfillment is found to be impossible or involves a use of means which are manifestly disproportionate to the protected right. The data subject has the right to oppose in whole or in part: for legitimate reasons, the processing of personal data concerning them, even if pertinent to the purpose of the collection; the processing of personal data concerning them for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication. In particular, the data subject can in any way ask the Data Controller for access to and rectification or deletion of personal data or restrictions on processing the data concerning the data subject, or to object to their processing, as well as the right to data portability. The data subject has the right to withdraw their consent at any time without prejudice to the lawfulness of the processing based on the consent given prior to the revocation and has the right to lodge a complaint with a supervisory authority.
